Terms and conditions of Monogram and www.monogram.lu

1. Operator of the online shop and applicability of these General Terms and Conditions.

The online shop named www.monogram.lu is operated by Monogram.

The general terms and conditions apply to all contracts of purchase between Monogram and the customer.

Without the agreement of the buyer to these terms and conditions a purchase is not possible.

The contractual purchase between the seller, Monogram (hereafter referred to as we), and the buyer (hereafter referred to as you, the customer) is governed in terms of products made by the seller (or purchased from third parties) in T&C with exclusion of all prior oral or written agreements.

All information about products and prices on www.monogram.lu are non-binding and without obligation.

2. Conclusion of contract

You are bound to your order once you have clicked the “Place Order” button at the end of the ordering process.

After you have placed your order, we shall send you an automated order confirmation to the e-mail address provided. The purchase agreement will only be concluded with the shipment of the ordered items and a separate confirmation e-mail thereof.

If a request cannot be carried out, the buyer will be informed as soon as possible.

3. Delivery time of goods

The time until delivery to the address you provided is about 2-4 business days after receipt of your order in the normal course of business. For orders on Saturdays, Sundays, and business holidays, this delivery period starts on the following business day.

Monogram cannot guarantee delivery times. In case a parcel might take longer to be delivered, Monogram is not obliged and will neither refund shipping costs, nor cancel the order placed.

Any package returned to Monogram due to an incorrect or incomplete delivery address will be forwarded at purchaser’s expense only.

The final delivery time consists of the time required for processing the order, packaging, and the given delivery time of the shipping company.

All shipments are made by Post Luxembourg.

We reserve the right to commission another shipping company for the delivery, if necessary.

4. Price

Shipping costs will be added per order. Pick-ups will not be possible.

The indicated prices are inclusive of the Luxembourg statutory value added tax of 17%.

The VAT amount is disclosed separately on your invoice.

5. International orders

Please contact Monogram by mail to mail@monogram.lu for a quote.

Additional delivery costs, customs duties and import taxes (if applicable) may apply and will be borne by the customer.

6. Payment methods

For orders within Luxembourg, the payment method by credit card is SumUp.

For international orders, Monogram will issue a detailed invoice.

7. Retention of title

The goods remain the property of Monogram until full payment of the purchase price and all associated costs and expenses are covered by the buyer. If all or part of the payment is delayed, we are entitled to assert our rights to retention of title.

8. Warranty and damages

The statutory warranty conditions shall apply.

All given details about the goods constitute quality specifications and are not a guarantee.

The products sold are covered by a commercial warranty to guarantee their conformity. This warranty does not cover damages due to natural wear or deterioration from normal use.

9. Right of withdrawal

You have the right to withdraw from this contract within 14 days (including weekends & holidays) from day of purchase.

In order to exercise your right of withdrawal, you must inform Monogram, mail@monogram.lu, of your decision to withdraw from this contract by an unequivocal statement. To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

10. Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, excluding the shipping costs, without undue delay and in any event not later than 14 business after we have been informed by mail about your decision to withdraw from this contract. You will have to communicate your banking details for all reimbursement requests. In any event, you will not incur any fees as a result of such reimbursement. Monogram may withhold reimbursement until the full return of the goods.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to Monogram.

You will have to cover the costs of returning the goods.

You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

11. Applicable law

The laws of Luxembourg apply to the exclusion of the conflict of law rules of international private law and to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

12. Force Majeure

Any unforeseen circumstances (force majeure), preventing commercial transactions under normal conditions, outside of the control of any of both parties, are considered an exemption of liability and lead to the suspension of the contract.

Are considered as cases of force majeure or incidental cases, in addition to those usually retained by the courts of Luxembourg: war, strike, riot, epidemic, earthquake, telecommunication shutdown.

13. Copyright and trademark

The Monogram website, its content, especially texts, photos, images, graphics, prints, textile designs, films, presentations, promotional ideas, sounds, illustrations, and software, as well as all trademark and/or design patents are all protected from unauthorized use by industrial property rights, especially copyrights, naming and image rights, trademarks and/or registered or unregistered design patents. Every use aside from the selection and purchase of an item requires our prior written consent or, if we do not possess the rights in question, the prior written consent of the rights holder.

14. Personal Information

Your submission of personal information through our store is governed by our Privacy Policy.

15. Final provisions

Should one or more of these terms and regulations be ineffective, this shall not invalidate the entire contract. The ineffective regulation is replaced by the relevant statutory scheme.

MONOGRAM’S ABOVE TERMS AND CONDITIONS ARE HEREBY RECOGNIZED AND APPROVED BY THE CUSTOMER.
